What is packaging
Normative references – Italian Legislative Decree No. 152/06
European Directive 2004/12/EC on packaging and packaging waste (amending and supplementing European Directive 94/62/EC) was transposed into Italian law by Legislative Decree No. 152/06 (formerly Legislative Decree No. 22/97).
According to Article 218 (definitions), paragraph 1: “For the purposes of this Decree, the terms below are defined as follows:
Packaging: Items made of any material used to contain goods from raw materials to finished products. They protect the products, enable handling and delivery from the producer to the consumer, and ensure presentation. This also includes disposable items used for the same purpose.
Sales packaging (primary packaging): Packaging designed to constitute a sales unit for the end user or consumer at the point of sale.
- Multiple packaging (secondary packaging): Packaging designed to group a certain number of sales units, regardless of whether they are sold in this way to the end user or consumer. It may only serve to facilitate shelf replenishment at the point of sale. It can be removed without altering the product’s characteristics.
- Transport packaging (tertiary packaging): Packaging designed to facilitate the handling and transport of goods from raw materials to finished products, excluding containers for road, rail, sea, and air transport. It helps avoid transport-related damage.”
All packaging (primary, secondary and tertiary) must display the alphanumeric coding required by European Directive 97/129/EC.
Packaging must be labelled in a form and manner deemed most suitable and effective by the company. Digital channels (e.g., apps, QR codes, websites) are permitted and can supplement or replace information on the packaging.
For plastic packaging made from polymers or combinations thereof not specified in European Directive 97/129/EC, reference can be made to standard UNI EN ISO 1043-1 for identification.
REQUIRED – The information required by Art. 219(5) MUST be included. The codes refer to European Directive No. 129/97/EC.
Disposal instructions may be communicated using the proposed formula or other effective methods.
